These Terms of Use ("Terms") govern your access to and use of peakoperationsgroup.io (the "Site"), operated by Peak Operations Group LLC ("Peak", "we", "us"). These Terms apply to your use of the Site only. Any actual purchase, quote, or supply relationship between Peak and a customer is governed by a separately executed Master Supply Agreement and the applicable Purchase Order, not by these Terms.
By accessing the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Information on the Site is provided for general informational purposes about Peak's services. Capability descriptions, lead times, tolerances, and certifications listed on the Site reflect the published capability of Peak's partner network under standard conditions. Specific tolerances, lead times, materials, and certifications applicable to any particular order are confirmed in writing in the applicable quote and Purchase Order, which control over any statements on this Site.
Submission of a contact form or RFQ through the Site does not create a binding contract. A binding agreement is formed only when (a) Peak issues a written quote, (b) the customer issues a written Purchase Order accepting that quote, and (c) Peak confirms the Purchase Order in writing. Until those steps are complete, Peak may decline any inquiry for any reason.
Information you submit through the Site, including drawings or technical data, will be treated in accordance with our Privacy Policy. Confidentiality protections beyond the Privacy Policy apply only after a mutual non-disclosure agreement is executed between you and Peak. Do not transmit highly sensitive technical data through the Site form before executing an NDA.
Content on the Site is not engineering, legal, regulatory, or financial advice. You should obtain qualified professional advice before relying on any information for a particular project, design decision, or compliance matter.
The Site, including its design, text, images, layout, and trademarks, is the property of Peak Operations Group LLC and protected by US and international copyright and trademark law. You may view and print pages for your internal business use, but may not copy, redistribute, or commercially use any portion of the Site without our prior written permission.
You agree not to use the Site to: (a) submit false or misleading information; (b) infringe any third party's intellectual property; (c) attempt to access non-public areas of the Site; (d) introduce malicious code or attempt to disrupt the Site; (e) use any automated tool to harvest information; or (f) violate any applicable law.
The Site may contain links to third-party websites. We do not control and are not responsible for the content of those sites.
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, REGARDING THE CONTENT AND OPERATION OF THE SITE.
TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE. PEAK'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE IS LIMITED TO ONE HUNDRED US DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO PEAK'S OBLIGATIONS UNDER A SEPARATELY EXECUTED MASTER SUPPLY AGREEMENT, WHICH GOVERNS LIABILITY FOR ACTUAL ORDERS.
You agree to indemnify and hold harmless Peak from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your unauthorized use of the Site.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in Chesterfield County, Virginia. You waive any objection to that venue.
We may update these Terms as the business or the law changes. The "Last Updated" date above will reflect the most recent revision. Continued use of the Site after an update constitutes acceptance of the revised Terms.
